Terms and Conditions
PRICE STRUCTURE & DISCOUNT: HySafe publishes only List Prices. Prices may be adjusted to meet market prices within product lines. HySafe reserves the right to make changes at any time without notice. Volume discounts and incentives paid for high sales volume may be considered. Possession of the HySafe Price List does not imply a right to distributor discounts. A distributor must have an approved credit application and be enrolled in HySafe’s Incentive Program in order to receive distributor discounts.
TERMS AND CONDITIONS: Terms and conditions are subject to change without notice. Once enrolled in HySafe’s Incentive Program, a distributor is bound by the terms and conditions of HySafe until terminated by either party with 30 days written notice.
TERMS: Net 30 days from date of shipment. All orders are subject to acceptance at our office. We reserve the right to invoice at prices in effect at time of shipment. We will sell and ship to approved credit only. We accept VISA and MasterCard. Credit can be established by furnishing bank and trade references on company letterhead.
FREIGHT: F.O.B. shipping point, freight prepaid and added to invoice. Title of goods passes to buyer upon delivery to carrier from our shipping point. Unless specified otherwise at the time the order is entered, we will ship typically via a ground service of our choosing. If any freight arrangements are required by the end user or distributor, such requirements must be communicated in writing with the order and accepted by the Company. We will drop ship to your customer (end user) but clear shipping instructions are the responsibility of the distributor. Expedited freight must be specified at time of order. We will consider prepaying freight based on size of the order on a case by case basis.
RETURNS: Authorization for return of merchandise must be obtained in writing prior to return. A 35% restocking charge will apply. Returns will only be accepted for materials which have not been used, in the original packaging and less than 30 days old. Custom products and orders and discontinued items or those sold as a promotion may not be returned. The company reserves the right to issue only a credit toward future purchases. Returned products must carry a Returned Goods Authorization (RGA) number and a copy of the form enclosed. Returns are to be shipped prepaid only.
Cancelled orders will not incur any restocking fee for normally stocked items. Special order items or unique fabrications may not be returned for any reason other than manufacturer defect. An RGA number must be obtained prior to returning any unique fabrication. Returns are to be shipped prepaid only.
WARRANTIES: HySafe and FPA warrant their products to be free from defects in materials and workmanship. The Company’s only obligation under this warranty will be, at the Company’s sole option, to repair or replace any part proving to be defective. HySafe’s liability in any case will not exceed the original purchase price of the item purchased. WARRANTY, Continued: For fall protection products, HySafe’s obligation applies to all assembled product and components determined by HySafe to have been defective during the warranty period of one (1) year from the date of purchase by the owner. This warranty does not apply to any assembly of component determined by HySafe to have become defective after having arrested a fall or as a result of an accident, alteration, misuse, abuse or servicing with parts not approved by HySafe.
THE OWNER/USER ASSUMES ALL OTHER RISKS, IF ANY, SUCH AS THE RISK OF ANY DIRECT, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE PRODUCT. HYSAFE DISCLAIMS ALL LIABILITY FOR ANY SUCH LOSS OR DAMAGE. THIS WARRANTY IS MADE IN LIEU OF THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. THIS WARRANTY MAY NOT BE VARIED OR EXTENDED EXCEPT IN WRITING BY AN AUTHORIZED OFFICIAL OF HYSAFE OR FALL PROTECTION ASSOCIATES (FPA).
HOW TO OBTAIN WARRANTY SERVICE: The distributor will notify HySafe and confirm shipping arrangements. All warranty returns must be approved in advance, shipped prepaid and follow the return policy including the use of the RGA form. NOTE: ALL PRODUCTS RETURNED MUST BE CLEANED AND DECONTAMINATED PRIOR TO SHIPMENT. Products received by HySafe covered with asbestos or other contaminant will not be accepted but returned freight collect.
COMPLIANCE NOTICE: HySafe products are manufactured to comply with applicable OSHA and ANSI standards for fall protection. ANY product that is subjected to the force of a fall or part of a system subjected to forces of a fall must be immediately removed from service. Please notify HySafe if there is any question as to applicability of this notice. ANY component of a personal fall arrest system that is subjected to the forces of a fall must be immediately tagged and removed from service until a competent or qualified person has inspected the equipment and certifies its use once again for fall protection. ALL personal protective equipment subjected to the force of a fall is to be PERMANENTLY removed from service (such as harness, lanyard, extension) while self-retracting lifelines may be serviced and certified for use again. Only a HySafe representative is authorized to certify products and systems. Certification of products or systems by any other party will void any warranty and liability of HySafe.
